Bike Accident Claim: What to Expect During the Legal Process

Table of Contents

You don’t have to go through the process of pursuing a bicycle accident compensation claim alone. As more people choose cycling as a regular form of transportation, the incidence of catastrophic injuries caused by road accidents is on the rise. Cycle SOS’s bike accident solicitors can assist you. We’ll help you feel confident in your compensation claim and understand the legal process, whether your accident was caused by a driver’s negligence or a road defect.

Between 2004 and 2021, pedal cycle traffic increased by 62% as more people took to riding a bike as a regular mode of transport. However, serious injuries caused by road traffic collisions and serious injuries while cycling have also risen by 27%, with the majority being due to the driver or the rider failing to look properly.

If you’ve experienced a personal injury due to a cycling accident, our specialist cycling solicitors at Cycle SOS will provide support throughout your bike accident claim, so you’ll feel confident in your claim for compensation and know what to expect during the legal process.

Specialist Legal Advice for Cyclists

What to do after being involved in a road traffic collision

Here’s what you need to know if you’re injured after a road traffic collision with another road user.

  1. Stay calm and be polite. This will help you to remain in control of the situation and stop any potential conflict. It will also make it easier for the emergency services, including any police officers attending the collision site, to listen to you and get a clear idea of what’s happened.
  2. Note the precise location of the accident and mark the point of impact if possible.
  3. Gather the contact details of those involved, this should include the names and addresses of any witnesses at the scene.
  4. You should report any injuries caused by the road traffic collision to the police as soon as possible and within 24 hours. You’ll also need to produce your insurance documents for anyone who has reason to see them within a week of the accident.
  5. Regardless of whether anyone is injured, it is a legal requirement to get the details of the driver involved, such as name and address, as well as the details of the registered keeper of the vehicle. If this doesn’t occur within 24 hours of the accident it becomes compulsory to report the collision to the police.

Check out our cycling injury claims calculator, for an estimate of how much compensation you may be entitled to once you’ve made your cycling accident claim.

If you’ve experienced a cycling injury due to a collision with another road user or hitting a pothole, take a look at how to report the incident, gather evidence for the legal process, and make a pothole claim.

What’s the legal process for a bike accident claim?

The majority of our bike accident claims operate on a conditional fee agreement, also known as ‘no-win, no-fee’. Essentially, you won’t pay for the legal process (including solicitor rates and paperwork costs) unless your compensation claim is successful.

Once you’ve contacted our experienced Cycle SOS team, we’ll work on your behalf to investigate the road traffic collision, examine the severity of your injuries, and support you throughout the legal process until you accept an appropriate settlement offer.

We can help you claim for personal injury, loss of earnings, associated medical costs, damage to your bike, and more. Although the majority of cases are settled out of court, if you do need to attend, we’ll be right beside you and ensure that you feel understood and supported throughout the legal process.
