In this video, we’ll look at Simon’s Story and his experience with claiming compensation after experiencing a cycling injury.
A 52-year-old married man and father, Simon is a keen runner, a keen cyclist and has a high level of physical fitness. On the day of the accident, Simon and his friend had ridden 50 miles on the roads southwest of the Lake District and were now returning home on a dual-carriageway.
Simon slowed down to turn off the busy road, and as he filtered from the carriageway, the front wheel of his bike fell into what we later discovered to be a narrow drainage tunnel. Simon’s bike stopped still, causing him to be thrown forwards over handlebars and onto the road surface. Simon suffered an injury and stayed in a hospital overnight. An X-ray revealed he had a severe shoulder fracture and required surgery.
At the time, Simon was advised to treat the fractures conservatively, allowing them to unite. The injury meant life had become extremely difficult for Simon as he could not carry out simple tasks and had to rely heavily on his family. Simon felt strongly that the advice he had received would not result in re-gaining his physically active lifestyle and sought a second opinion.
He was recommended to opt for private surgery and, around 4 weeks after the surgery, could now do some of the basic day-to-day tasks. However, Simon could still not drive, and his work was still affected. The surgery also left Simon with a scar and he doesn’t know if the metal will be removed from his shoulder.
Simon chose to make a compensation claim to help others avoid being in the same situation. Although now compensated, Simon was in a fortunate position to pay for private surgery. However, he understands many people may not be and could be left with financial difficulty or the alternative of not having surgery, which may result in a severe long-term injury.
