What Is The Local Council’s Responsibility Towards Potholes?
In England and Wales, potholes on main roads and motorways are the responsibility of Highways England and the Welsh Government. Potholes on local, minor roads are the responsibility of local councils. Both are responsible under S41 of the Highways Act 1980 to maintain a safe Highways network. According to The Asphalt Industry Alliance, local authorities spent £93.6 million repairing 1.7 million potholes in 2020-2021 which equates to a pothole being filled in every 19 seconds.
