What Happens If You Get Caught Drunk-Cycling?
There is no power to disqualify a person from cycling nor can a cyclist be compelled to provide a sample of breath, blood or urine as a bicycle is not a mechanically propelled vehicle, unlike an e-scooter, an e-bike or mobility scooter. Users of these devices have found themselves deprived of their driving licences after cycling drunk. On conviction for cycling while under the influence the penalty is a fine.The current catch-all for cyclists is the offence of Wanton or Furious Driving under the 1861 Offences Against the Person Act, a bicycle having been found to be a ‘vehicle’ for the purposes of this Act.
