The Incident
Our client was cycling along Westbourne Grove in London when the defendant, driving in the same direction, attempted to turn left into Hereford Road. Failing to see our client, the defendant collided with her right-hand side. The impact caused her bike and right leg to go under the defendant’s front left wheel, resulting in significant injuries and damages.
Injuries Sustained
As a result of the collision, our client suffered the following:
- Right leg and lumbar spine pain and bruising
- Right leg: Severe pain and bruising for four weeks after the accident, now moderate and intermittent pain
- Lumbar spine: Severe sprain/strain for four weeks post-accident, now moderate and intermittent pain, with referred pain to the right lower limb
- Travel anxiety
- Moderate insomnia caused by traumatic shock
The Case
The claim was initially submitted to the Ministry of Justice Claims Portal before being referred to Cycle SOS. Associate Solicitor Jayne Orme and Litigation Executive Diane Holderness handled the case.
Liability for the collision was accepted by the defendant.
The client was examined by a GP and recommended for a follow-up examination. However, before this could take place, the defendant’s insurer made an offer for the personal injury element of the claim which the Claimant wished to accept. At the time the Claimants other losses excluding the injuries had not been collated so these had to be gathered together before the information could be sent to the insurers.
The insurer initially made a low offer for travel expenses. Our expert cycling accident lawyers countered this offer, resulting in an increase. However, further challenges from the insurer required a detailed review of travel expenses, including providing a year’s worth of bank statements. Ultimately, the client decided to accept the revised offer, and a settlement was agreed on the same day.
The Outcome
Jayne and Diane successfully secured a settlement of £4874.99 for our client.
